BE The Publisher

To Finalize Our Month of “BEING,” in which EntreMusicians can take advantage of a few of the Wonderful Opportunities which await those with Initiative, we’ll end September in a space that I cherish the most .

I have been passionate about Music Publishing since the eighth grade. I was the kid who read all of the liner notes on the album. I learned the Record Label Names, Executives, A&R Personnel, Where the Album was Recorded, Mixed, Mastered – Who the Engineers were, Producers, Arrangers, Session Players – Who the Songwriters were and then… Publishing? ASCAP, BMI, SESAC? What does this all mean?

I started reading. I went to the library and borrowed “Making It With Music” by Kenny Rogers and Len Epand. I didn’t return it. For the first time I heard and realized that the Song is the Most Important Instrument in Music and the Person(s) who Owned/Controlled the Song’s Publishing will be the Most Important Instrumentalist(s) overtime.

Upon further investigation, I found that the Term (Lifespan) of the Copyright lasts 70 years after the Death of the Composer(s) – or up to 120 years in certain situations.

Further along, I heard the incredible Horror Stories of the Thousands or more Songwriters who were completely skewered out of their Publishing Ownership, Royalties or Both, ignorantly traded for the Price of Fame, a Shiny Cadillac or even a House, while the Publisher went on to earn Millions. To add greater injury, I learned that although Tin Pan Alley may have started as a true collaboration between Songwriters & Publishers, many of the Corporate Conglomerates who Took Over Music and Earn The Most, by far, are Attorneys – some who can’t even whistle in key or snap their fingers on beat. Remember Paul McCartney of All People only recently began owning the rights to his music, having to BUY It Back!

I determined early on that more important than practicing my drums (which I do regret to some extent) that I would become a Student of Publishing, Start My Own Companies and Keep All that I could. I would Never, Ever sign away ALL of it, no matter how much moola I was offered, unless it was purchased outright. Overtime I saw how Technology alters the Art & Nuance of Publishing and that I Need to Pay Attention Often. It’s like being married!

Before I recommend that You BE Your Own Publisher (and I strongly suggest you do), I must admit that there are some very reputable publishers out there. All of them are Not Snakes, but You Need to Do Your Homework and Triple Check It Before Signing. Publishing is Extremely Difficult Work and since Your Territory IS The World, having a Strong Sub-Publisher Looking Out for Your International Affairs is Vital. Since Publishing can easily become a full time job, provided You’ve Got a few Songs shaking on Radio, TV and/or Film, You should Employ a Loyal, Committed Team who can Advise and Monitor the Very Best Deals for Your Career.

Remember, Your Number One Goal is to Help Your Song Continue Earning Money for You, Even Years After You Write/Release It. You Want Your Songs to Reap Royalties for Your Family and Your Estate when You Can No Longer Pick Up Your Drum Sticks. Publishing is a Space where “Exploitation” of Your Work is a Very Good Thing – So Having Multiple Artists in Multiple Genres Record Your Songs is a the Lifeblood of Your Team. Think PrinceStevie and for crying out loud, Think Diane Warren!

I’m blessed to be entrusted with publishing songs for several songwriters in my area. It’s a Trust that I Hold Sacred and Dear. I Preach Publishing and Make Sure They Know As Much as I Do about this Business and the Activity of their Music. Our Terms and Conditions are Beyond Fair, meant to Lease and Not Own, so that All Ownership and Control is safely reverted back to them. I haven’t made nearly as much in publishing as I’d like to – YET! But there’s always that Next Project, TV Commercial, Indie Film or Up & Coming Artist that keeps us Alert and Hustling!

BE The Actor

Continuing our September trek down the Avenue of Opportunities EntreMusicians are free to follow, we pause to consider an oft overlooked jewel that could help Build an Enduring Brand while providing Additional Income for years to come. Have You Considered the Wide World of Acting?

I Have and have Enjoyed Occasions to Stretch My Capacity. I’ve included a few clips below. You may or may not find them absolutely incredible and Academy Award worthy, but the Lessons I’ve learned, Experience I’ve gained and Connections I’ve Secured as a result of taking these risks have endured to my advantage.

5) The Preoccupations of Acting Heightens Your Sensitivity to Everything Going Around You While Demanding an Exacting Performance Every Single Take.     (Every EntreMusician Reading This Can Relate…Especially if You’ve had to play drums with a pounding headache!!)

With sincere respect to the True Art & Profession of Acting, I have found within my tiny experiences that the most the Director expects of you aside from professionalism is to Relax and Be Yourself (especially while ‘In Character’)

Haven’t You Noticed that ALL of the Actors & Actresses You Know and Love are actually only playing Themselves on Stage & Screen?

In Almost Every Movie Denzel, Duvall, De Niro, Depp & Downey, Jr. retain their distinct personalities! Different Script, Different Character (supposedly), but the same basic disposition, emotions and approach. The reason we love their movies, is because we love THEM!

So Memorize Your Lines, Dive into The Script and Develop a Magnetic Persona that will Increase Your Email List and Strengthen Your Fan Base.

I have been blessed to act in three independent movies, having contributed to the scores of two and playing the lead role on stage in the off roadway adaption of David Lee Talbert’s “The Fabric of a Man”. In fact, I was so completely naïve that I didn’t know I was the lead!!

BE The Booking Agent!

concert audienceSince September is a Traditional Educational Month, I Will Spend it with You by Sharing A Few of The Ways I’ve Honed My EntreMusicianal Skills by “Being” All The Things I’ve Needed to “Be” to Advance My Artistry & Career, while making a few bucks along the way. 

Being an EntreMusician comprises being adept at all of the functions of an Artist’s Career. Managing all the aspects of your own career can be its own unsettling balancing act. However, when you’ve become adept at walking atop your own tightrope, you might find it profitable to help someone else gain stability. 

It’s Common Practice for any Musician to refer another band for a gig they aren’t able to do. The second step is becoming noted for intentionally hooking up other talent for an event or venue and receiving a reasonable fee for doing so. 

For a few years now, since my days as producer of the event formally known as the Youngstown Jazz Fest, I have been able to align various artists with a variety of regional events. Both parties are aware that I represent the Band/Singer/Musician as an agent exclusive to that performance.  

I charge an extremely affordable rate, based upon the amount of work I need to do – and I keep it very basic. This fee is ALWAYS Collected from the Venue and Never from the Artist. I am doing them both a favor, but the advantage is Always Towards My Fellow EntreMusician. 

I Only Recommend bands I KNOW are completely dependable with a Killer Show to Event Promoters that I KNOW will Treat Them Right and Will Pay. If I am Not Confident of Either of these Attributes, I don’t get involved.  

I Send an Agreement on Behalf of the Performer, Collect the Non-Refundable Deposit and Secure the Date. I don’t get mired into the tiny details letting the bandleader and venue owner customize the event. I Am Not the Band’s Manager and I Never Insert Myself into that Role. 

I’ve had only 100% Satisfaction Rate so far for these “Favors.” The best thing is I Don’t have to be there on the night of the event, unless I want to. I Invest My Time in Concentrating on My Own Production and/or Performance!

SounDoctrine asked fans to send in their wedding pics to be featured in our video for the song “Marriage.” The Response was Overwhelming and made for a Great Way to Celebrate the Sacredness of Marriage.
6. Invite Two Fans to A Rehearsal. Have them Stream it on their Pages.
7. Invite Three Fans to A Recording Session. Upload it to Your Website.
8. Have a Fan Host an Old Fashioned House Party. Sell Tickets for $4.99. Stream It!

SounDoctrine partnered with author Gregory S. Trent who wrote the book “Selah,” which was the exact title of our single “Selah” from the ‘Source’ CD. For 30 Days after the initial release, anyone who bought his book got the single as a ‘Freemium’ (our $$ agreement was with him).

Yeah, I Know, but sometimes you have to draw a line in the sand. This move turns Fans into Family – or Enemies! It doesn’t have to be a Presidential Race, but Someone Your Band Strongly Believes will Make a Difference in Your Community or Country.
17. Throw a Private Party Twice a Year with Invitations Only for the First 25 or 50 Fans who Must Show Up by a Certain Time!

Hold it in a Very Public Place, Ensuring Liability Insurance, Security, etc and Make It Very Special!
18. Produce a Live Event that promotes Other Named Acts and make it a Regular Event!
We were blessed to produce the Youngstown Jazz Fest for three consecutive years, which we spun off into a monthly “Second Sundays” Event which garnered corporate sponsorship and featured artists of much higher caliber than SounDoctrine, which kept our name associated with Quality.

I’ve Never Missed an Opportunity to Give a Person a Chance. Sometimes it’s set me back, Sometimes I’ve been bitten, but Often I’ve gained so much more in wonderful collaborations.
44. Remain Humble. Be Polite. Don’t be a Jerk.

Perform an Assembly with an Educational / Anti-Drug Theme.
And Don’t be a Hypocrite. (Ask Me About This One).

Always in Advance

Last Week We Discussed the Importance of Always Making All of Your Agreements with Promoters & Venue Owners In Writing. Today, I want to emphasize, Especially to Younger EntreMusicians the Seriousness of Always Getting PAID in Advance.

The First Step to Achieving this Objective Immediately after Negotiating a Fair Price (based upon Your Experience, Reputation & Sales) is to gently Reaffirm the Date Your Deposit is Due. Remember it’s Printed in the Agreement.

The Second Step Stipulates the Time Your Balance is Due. And It’s Always Prior to the Start of Your Performance. Sound Check is an Ideal Time. All the Equipment is out of the Van, You’re Plugged in and Properly Preparing, On Their Stage! There is No Argument or Sign of a Breach on Your Part – Now is the Perfect Time for Them to Complete Their End of the Deal. Specify This is You Somehow Failed to Reach a Prior Understanding, or if Mrs. Club Owner suddenly comes down with a case of ‘Forgetfulness.’ If Your Written Agreement is Clear & Concise, then Stand Your Ground and Refuse to Go On Until You’re Paid – but Leave Your Equipment Intact, Plugged In, On Their Stage.

If You are a Younger Performer, these types of Standoffs may seem Intimidating, Unnecessary and are Not Why You Got Into the Biz – Besides Your Older Cousin Bobby (who taught you how to play drums) is coming to tonight’s show, so You just wanna Play!

But Remember You Cannot Repossess a Performance…

If Mr. Promoter should Weasel Out of Any or All of Your Payment, That Incredible Sax Solo and Ultra-Phat Rhythm Section Cannot be Recalled or Resold (unless you’ve recorded the hit and plan on selling CDs, but I digress…) It’s Worth Everything to Wait Before Potentially Giving Your Show Away. Again, I’m Assuming You Already Have A Written Agreement in Place.

This is Not the Time to Begin a Whining or Screaming Session. Remain Professional.     Order Food from the Bar or Order Out. Chill Backstage and Wait Till the Hall Fills Up.         The Closer it gets to Showtime, the More You Will See the Balance Shift. Be Prepared to Hold Out Until the Money is In Your Hand. Then Go Out There and KILL!

For Many Years, I have Also Made it a Habit to Always Pay My Fellow Band Members in Advance. As a Bandleader, I Set a Precedent that Allows My Partners to Concentrate Only on the Music and Not On Whether They Will Hear A Sob Story from Me, Quite Possibly Blaming the Club Owner because I Did Not Do Due Diligence.

Headaches are not Something You Need on Game Day, So Prepare Accordingly.                 This Practice Not Only Increases Your Business Acumen, but Solidifies Your Stature among Your Musical Peers as a Serious Professional.

POWERLESS??

SPOTIFY AND APPLE ARE AT EACH OTHER’S THROATS…, Apple in Talks to Acquire Jay Z’s Tidal“…, YOUTUBE’S DOMINANCE TAKES A BEATING“…, & The Music Industry Just Lost a Big Fight with the Government Over Royalties” are just a few recent Headlines glaring in the faces of EntreMusicians. And the New News is Spotify Tops 35m Subscribers which continues to support the David & Goliath mock-up we’ve been fed for decades.

Sure, there are Certain Things that Intimidate Us, Most of Us are NOT Millionaires.

But Are We Powerless?  Or Do We Merely Think We Are? Who Convinced Us of This?

Are we Really in No Position to Change this Music Game and Reroute Our Artistry Directly to Our Individual Friendbase while Bypassing The Current System?

Is the notion of An Independent Streaming Model Available to Each EntreMusician Intelligent Enough to Create Continual Content too Difficult to Imagine?

If a $1.99 / $2.99 Exclusive Access Tier from Our Own Individual Channels were Created & Maintained, a Far Fairer Form of Compensation, and perhaps Appreciation, of our Art would be Enjoyed. Obviously, We’d Bear Sole Responsibility for Building & Nurturing our Tribe, but the Truth is We Do This Now while Reaping No Advantages

These Are the Questions I Continue to Ask, Conversations I Constantly Engage and the Plan I AM Currently Implementing.

In Numbers 13 (OT), Moses sends out 12 Spies to Investigate the land The Lord had appointed for them To Conquer. Forty Days Later, 10 of them returned with a Thoroughly Wimpy & Faithless Answer – even confessing that they felt as small as grasshoppers amidst the citizens there and must have looked the same way to them!

This Week I take a Break on My Lone Diatribe of the Current State of the Music Industry and that which I feel EntreMusicians Can/Should be Doing to Alter the Ugly Tide. As I Reflect & because I Am Quite Passionate, It seemed I was beginning to Sound like a Whining Polemic, which was/is not my intention.

My Goal here is to Engage, Encourage & Empower EntreMusicians Everywhere to Embrace their Artistry with the Highest Level of Significance & Inspiration.

To that End, Today I wish to share the Importance of Creating Systems in Your Day/Week/Life which Propel You toward Consistently Attaining New Heights in Your Career.

If You’re Anything Like Me, or the Millions of Other True Creatives, Our Souls Find Meaning in Abstracts. We tend to “Feel” More than We “Reason.” Creatives are More Apt to Be “In The Moment” than “In The Long Run.”

As a Intense Jazz Lover & a Participant in the Genre, the Sheer Intention of Improvisation is Always Intriguing and a Blessed Experience, but without the Foundation of a Steady Rhythm, Chord Patterns, Motifs & Melody, the Magic Mercurially Melts.

EntreMusicians Understand this Balance. We Incorporate Habits, Rituals & Systems into Our Days/Weeks/Lives to Provide Security for the Spontaneity. We Emphasize Structure so our Creativity Soars.

Although Creatives Understand the Disciplines that Apply to Our Craft, and subsequently Practice our Fingers Off, We Rarely Develop Regiments around Our Art to Promote, Sustain and/or Catapult Our Careers & Influence.

Here Are A Few Questions for You To Consider:

a) Do You Have a Daily/Weekly/Life “To-Do” List?

b) Do You Maintain a Morning Ritual?

c) Have You Established Boundaries on How You Spend Time in Each Sphere of Your Life?

d) Is there a Proper Balance for Personal & Professional Relationships & Goals?

e) Have You Formed a Team to Keep You Accountable to Your Aspirations?

The Way You Answer these Questions Will Help Shed Light on what You Need to Do to become More Effective & Efficient in Harnessing Your Creativity & Accomplishing What Truly Matters.

You Mean They Drilled Into His Vault??

Obviously I have waited for what I feel is a respectable amount of time to bring this topic up. And I No Way Feel a Disconnect from the Main Topic I have espoused for the last few months, beginning weeks prior to Prince’s Majestically Mysterious Departure.

I have been asking “How You Define Success,” “How Important Are You,” and slowly initiating an Obsessive “Psychology behind the Philosophy” Mantra for EntreMusicians to Rethink our Entire Dependence on Spotify, Pandora, Apple Music and the Upcoming Amazon Streaming System. Reflecting on The Purple One’s Intense Fight for Independence from Warners, His Mysterious Death (You Mean He was Left All Alone, All Night In That Huge Complex After Almost Dying a Week Earlier?), One of the Speediest Cremations of a Body Not Dying by Fire and to Top It All, his Private Music Vault Drilled Open Less Than 10 Days After His Death?!?!!

In Considering He was a Single Man at the time of his passing, Intensely Private and that he Left No Will, One of the Single Most Important Questions EntreMusicians Must Ask themselves is “Who Is My Advocate?” It seems that Tyka and the rest of his half-siblings, along with the Well Intentioned Shelia E, Larry Graham, Morris Day and others who knew His Royal Badness Extremely Well have to Sit on the Sidelines while an Attorney & A Record Company Executive muses through his Intellectual Property.

If  This  Doesn’t  Scare  the  Rhythm  Out  of  You,  You’re  NOT  A  Musician!

Here are a Few Questions You Should Ask & Answer before the End of this Blog:

“Does My Spouse/Significant Other Know Where My Copyright-Publishing Information Is and Can They LEGALLY Speak for Me if I am Physically/Mentally Incapacitated or am Deceased?”

“Where Is My Will and Is that Sucker Updated?”

“Do Select People I Love and Trust Have the Necessary Passwords to my BMI/ASCAP/SESAC and other Pertinent Accounts”

“Have I Explained Very Clearly My Wishes for My Musical Equipment/Software?”

 “Are My Collaborative Agreements with Other Songwriters/Band Members In WRITING and In Order?”

“Are My Trustworthy Attorney & Accountant Up to Speed on My Wishes for any Unreleased Music I Might Have?”

“Have I Backed Up My Hard Drives and Entrusted them to Safe People/Places?”

Hopefully, these are Enough to Encourage You to Become Very Intentional about the Inevitable. Taking Care of Business is Always of Ultimate Importance for the Intelligent EntreMusician.

How Do You Define Success?

It’s Different for Everyone.

Some Bands quantify Success as having their Music on the Most Popular Platforms whether or not they are being Paid a Fair Rate to be there.

Others firmly believe that if they pay the Club Owner to Perform in front of the same 64 patrons who attended last month, it will eventually lead to more visibility. It Might.

Then there are those Artists who are just happy to receive any kind of exposure at all. They see Creating a Unique ‘Sound,’and/or Narrowcasting & Building a Devoted Tribe as a Complete Waste of Energy. They view success as performing better than that Other Cover Band in the Bar Next Door and Showing Up Next Week to Do It All Over Again.

Now, It’s Perfectly Fine to embrace those  Definitions. There are One Million Others.

However,

An EntreMusician Seeks to Move Beyond Mere Success to Significance, because Scaling Definitely Matters – And Significance Does Not Celebrate 30,000 Streams last week if she only received $12.40 and a write up in her local paper.

Yet Significance also means Declining a Substantial Gig to tutor his Fifth Grader in Math or attending his Daughter’s Dance Recital, again.

An EntreMusician treats her work as Highly  Essential & Important. Too Important to Sacrifice at the behest of Another’s Unfair Advantage. If & When She Decides to Give Her Art to Someone, her reasoning is more Transformational than Transactional.

He Values Precious Time & Regards Committed Relationships as too Vital to Miss Magnificent Moments chasing Dimes. The Work Still Gets done, but never at the expense of Family.

The EntreMusician equates Success with Riches, but Significance with Wealth.

You Can Either Agree to The “Usual” Pay Scale of the Masses or CHOOSE to Negotiate Your Fee.

It’s Up To You.

Your Self Importance is the Sum Total of Your Own Thoughts, Experiences & Esteem.

Your Self Importance is Directly Tied to Your Own Vision & Goals.

You are Either One Who Sees Him/Herself as Having Very Little to No Worth – or – Someone Who Envisions Endless Possibilities. You Either Settle or You Set Out.

It’s Up To You.

Although Present Options may be Limited, Important People are Always Creating Opportunities to Change that Present Situation and Improve Their Positioning.

EntreMusicians MUST Embrace the Realization that Our Art, Music & Creativity is IMPORTANT. We Must No Longer Accept or Agree to Selling Ourselves Short and/or Out!

It’s Time To Set A Price For Our Shows & Songs that Reflect Fair, Equitable Standards which Put Money in Our Own Pockets or Refuse to Participate on Their Platforms & Stages.
